http://REtipster.com/how-to-do-your-own-title-search/ One of the most crucial steps to closing on any real estate transaction is the title search. As an investor, you need to do prudent research and be 100% sure that the person you're buying from has a clear title to the property. You need to ensure that you're getting a deed and paying the actual property owner (not somebody else who thinks they own the property, or is lying to you and claiming that they own it). When I bought my first house, this whole concept really confused me and if you're new to real estate, it may seem confusing to you too... Why A Clear Title Matters In a lot of ways, it's a similar process to buying an car. Suppose you see a car parked in someone's driveway with a "FOR SALE" sign in the window. The car looks nice, so you walk up to the house, knock on the door and say "I saw this car parked in your driveway, is it yours?" The person replies, "No, but I'll sell it to you for $10,000!" There's obviously something wrong with this picture. A person can't sell something they don't legally own -- and while it sounds like a ridiculous conversation, you'd be surprised at how often I've come across situations just like this in the real estate business. How does this kind of issue come up in the first place? There are a lot of ways but most often, I come across people who have inherited property from their parents or relatives and somewhere along the way, the proper paperwork was never filed to give them the legal right to sell the property. Other times, people buy properties without doing their own due diligence and then THEY get stuck with a property without a clear title. One way or another, people can end up with their name on the tax bill (and in some cases, on the actual deed), but somewhere in the "chain of title" (as recorded in the county's historical documentation of the property) the property wasn't transferred correctly from seller to the buyer. Another key reason you'll want to do a title search is to make sure there aren't any liens or mortgages on the property. Especially when you're offering people a very small amount of cash for their property (like I tend to do), there will be times when they conveniently neglect to mention that they have a $100,000 mortgage or $20,000 construction lien that is still tied to that property. If you fail to catch this in your title search before closing on the deal, these issues will fall into your lap along with the property. If you make enough offers and buy enough properties, you will eventually run into this issue. When you do, it's usually a problem that doesn't have a quick or easy solution. Knowing When It's Worth The Price Admittedly, doing your own title search will open you up to some risk. There is always the possibility that you'll miss some crucial piece of information along the way. However, I have done a few dozen title searches on my own over the years and I have never been burned by it. As a personal rule -- the only time I do my own title searches is when the expected market value of the property is less than $10K (i.e. -- we're talking exclusively "rinky dink" properties here). As soon as I start dealing with substantial deals in the tens of thousands, I never leave it to chance. At that point, the cost of a full-blown title insurance policy is more than worth the cost. #retipster #sethwilliams #landinvesting #realestateinvesting #realestate

Note Buyers Review - The Truth About Note Exchange Websites?

Official Website: http://www.nicholasdicaro.com/ In most cases, you should not post your note on an exchange website. Many investors do not purchase notes that are listed on any websites. If you post your mortgage note or deed of trust on a loan exchange website then, you have immediately lowered the value of that asset and most likely it will be more difficult to sell. There are 3 main reasons this is true. Reason #1 This is true because privately held mortgage notes are not a commodity and do not deserve commodity pricing. Mortgage notes are not priced like a pound of sugar or an ounce of gold. Pricing is completely dependent upon an extensive list of variables. Exchanges force excessive bidding for non-conforming, non-traditional assets, where there are a whole host of unknowns that are impossible to tell from a couple of pages of information posted online. The unknown variables are 1. Current value of the property, 2. Current credit of the Payors, 3. Clear Title report, 4. Accurate Documentation, 5. Proof of payments (or lack thereof), 6. Lack of Financial Background information on the Payors (Is the Payor employed? How much do they earn? What are their earning capabilites for the future?) 7. Is there a current Fire Hazard Policy naming the Mortgage Note Holder as an additionally insured (without this, the collateral is jeopardized) 8. Are the borrower's going to be cooperative with the process or are they going to be hard to deal with? 9. And many other unknown's that are impossible to tell without speaking to the mortgage note holder, looking at the documents, and analyzing the details of the deal. Reason #2 is more scary and is even more important than #1. Reason #2: There are a bunch of people in the world today that think they can make money without working. They call themselves Note Finders or Note Brokers and instead of actually working to find deals to buy, they think they can make money by copying and pasting all of YOUR information that YOU posted on that exchange website, and then they post it on another website as if it was theirs. They might post it on 10 different websites, and by the time YOU actually find an interested investor to buy your note, that investor won't be interested in spending his time because he's already seen it from 5 other people, so why would he believe that you are the REAL owner of the real estate note? He won't know if YOU are the actual owner of the note or the other guy.... So he won't even give you the time of day. Reason #3 is this: Most people who contact you about buying your mortgage note or deed of trust through a loan exchange website, are not actual investors themselves. They are the Note Finders and Note Brokers who try to tie up YOUR deal so they can sell them directly to companies like us DICARO & ASSOCIATES, LLC. I am a real estate trainer, mentor and full-time real estate investor actively buying, selling and holding properties each month for huge profits and long-term cash flow. When I first started almost 22 years ago, I thought I wanted to be a wholesaler and flip contracts because I thought I needed a bunch of cash to buy and hold, or buy and rehab houses. I was like everyone else starting out in this business. I didn’t have lots of money, so I thought wholesaling was the easy way to go. Boy was I wrong. Fortunately for me I was introduced to a buying technique called “Subject-To” by a friend. This is a technique where the Seller deeds the property over to you (you own it) but leaves the loan in place and you simply continue to make the existing payments (you don’t have to go to the bank and qualify). Well I must say this technique changed my life. Within the first 30 days of learning the Subject-To technique I bought 4 houses for one dollar each (yes, you read that correctly) and I have been buying them that way ever since. I no longer have to sell the “Golden Goose” to make lots of money. Today I am working furiously at buying properties “Subject-To” using the existing financing on the seller’s home instead of having to go to a bank or a hard money lender for funding. This allows me to buy multiple properties fast, without coming up with all the purchase funds on the front end. Subject-To is the perfect strategy to use in today’s market where easy funding is not readily available for investors to buy pretty houses. Buying houses “Subject-To” the existing finances is by far the most powerful technique is real estate today. You can control and own an enormous amount of real estate with very little money. Understanding how to get sellers to finance your deals is the ultimate investment strategy. If you’re a person who doesn’t have a lot of cash, or doesn’t have good credit or simply doesn’t want to use your credit, then you need to attend the upcoming Tampa REIA meeting where I will be teaching you how to effectively use this technique. On Monday, July 30, 2018, Kim received notification that our potential buyers had accepted our creative offer to buy our horse ranch. We’re selling the ranch for $497,900. Potential buyers needed to first sell their primary residence so they could qualify for an institutional mortgage to pay for our ranch. I met with potential buyers on Friday, July 27, 2018. I’d just gotten back from a 3-month road trip in the motorhome teaching creative deal structuring around the country. NOTE: you can creatively buy AND SELL homes. The Creative Sale Structure: 1. We will sell buyers our $497,900 horse ranch for only $300,000. 2. This will allow them to qualify for a mortgage and buy our ranch without having to first sell their house. 3. At closing, buyers give us an option to buy back ranch for $300,000 at anytime over 30 years. 4. This option is secured to the property via a Security Deed (Georgia is a Deed of Trust state). 5. We give buyer an option to buy our option at any time in the next year for $197,900. 6. When buyers’ house sells, they can use sale proceeds to buy back our option ($197,900) 7. If buyer buys back our purchase option within the next year, the sale price of the ranch will have been $497,900 - our asking price. 8. If buyer DOESN’T buy our option, then we capture ALL appreciation over next 30 years and can buy back the ranch at any time for $300,000!!!
